Terms of Service - CleenVerify

1. Acceptance of Terms
By accessing or using the CleenVerify mobile application ("App") and related web services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and CleenVerify ("we," "us," or "our").

2. Description of Service
CleenVerify provides hardware-backed cryptographic verification for digital media (photos and videos). The Service allows users to:
- Capture media using the CleenVerify App with cryptographic signatures
- Generate shareable verification links proving media authenticity
- Verify media authenticity via web browser at cleenverify.com/verify
The Service leverages device security features (Android KeyStore) to create tamper-evident digital provenance records.

3. User Accounts and Registration
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account

3.2 Eligibility
You must be at least 16 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.3 Account Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we deem harmful to the Service or other users.

4. Service Plans and Pricing

4.0 Beta Program
CleenVerify is currently in closed beta. All features are provided free of charge during the beta period. Subscription plans described in Sections 4.1–4.5 are defined for transparency and will be activated upon public launch.

4.1 Free Plan
The Free Plan includes:
- 5 verifications per month (media uploads with cryptographic signing)
- Access to web-based verification portal
- Basic support via email
Monthly verification limits reset on the 1st day of each calendar month.

4.2 Pro Plan
The Pro Plan (€4.99 per month) includes:
- Unlimited verifications (no monthly cap)
- Priority support
- Early access to new features

4.3 Payment Terms
- Pro Plan subscriptions are billed monthly in advance
- Payments are processed via Mollie and are subject to their terms
- All prices are in Euros (EUR) and include applicable VAT
- You authorize us to charge your payment method on a recurring basis
- Subscription fees are non-refundable except as required by law

4.4 Plan Changes and Cancellation
- You may upgrade from Free to Pro at any time
- You may cancel your Pro subscription at any time; cancellation takes effect at the end of the current billing period
- After cancellation, your account will revert to the Free Plan

4.5 Price Changes
We reserve the right to modify subscription pricing with 30 days' advance notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

5. Acceptable Use Policy
5.1 Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. Permitted uses include:
- Verifying authenticity of product photos for online marketplaces
- Establishing provenance of personal media
- Demonstrating compliance with content authenticity standards

5.2 Prohibited Conduct
You agree NOT to:
- Upload media containing illegal content, hate speech, or explicit material
- Use the Service to harass, threaten, or defame others
- Attempt to reverse engineer, decompile, or hack the Service
- Circumvent usage limits or access controls
- Use automated tools (bots, scrapers) to access the Service
- Resell or commercially exploit the Service without authorization
- Upload media that infringes third-party intellectual property rights
- Impersonate another person or entity
- Interfere with the Service's operation or infrastructure
Violation of this Acceptable Use Policy may result in immediate account termination.

6. Intellectual Property Rights
6.1 CleenVerify IP
The Service, including its software, design, trademarks, and documentation, is owned by CleenVerify and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6.2 User Content
You retain all intellectual property rights in the media you upload ("User Content"). By using the Service, you grant CleenVerify a worldwide, royalty-free license to:
- Store, process, and transmit User Content as necessary to provide the Service
- Generate cryptographic signatures and verification metadata
- Display verification results to third parties who access your verification links
This license terminates when you delete your User Content, except for archival copies retained for legal compliance.

6.3 User Content Responsibility
You are solely responsible for User Content you upload. You represent and warrant that:
- You own or have rights to all User Content
- Your User Content does not violate third-party rights
- Your User Content complies with applicable laws
We do not pre-screen User Content but reserve the right to remove content that violates these Terms.

7. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and processing of your personal data as described in the Privacy Policy.
Key data practices:
- We process personal data in accordance with the EU General Data Protection Regulation (GDPR)
- User Content is stored securely with encryption
- Metadata (timestamps, location data) is retained for verification purposes
- You have rights to access, correct, and delete your personal data

8. Third-Party Services
The Service integrates with third-party services, including:
- Mollie for payment processing
- Google Play Services for app distribution
- Cloud storage providers for media hosting
Payment processing via Mollie is not yet active during the beta period. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services' availability, security, or practices.

9. Disclaimers and Limitations of Liability
9.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:
- Merchantability and fitness for a particular purpose
- Accuracy, reliability, or completeness of verification results
- Uninterrupted or error-free operation
- Security or absence of viruses

9.2 No Guarantee of Verification Accuracy
While we use industry-standard cryptographic techniques, we do not guarantee that:
- Verification results are 100% accurate or tamper-proof
- Third parties will accept or rely on verification results
- The Service will detect all forms of media manipulation
Users should independently verify critical information.

9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEENVERIFY SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Damages arising from unauthorized access to your account
- Damages resulting from third-party reliance on verification results
OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €50, WHICHEVER IS GREATER.

9.4 Consumer Rights
Nothing in these Terms excludes or limits liability that cannot be lawfully excluded under Dutch consumer protection law, including liability for death or personal injury caused by negligence.

10. Indemnification
You agree to indemnify, defend, and hold harmless CleenVerify, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your User Content or use of the Service
- Your violation of third-party rights
- Your violation of applicable laws

11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting us at info@cleenverify.com. Upon termination:
- Your access to the Service will cease
- Subscription fees will not be refunded (except as required by law)
- User Content will be deleted within 30 days (except as required for legal compliance)

11.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms
- Your account is inactive for 24 months
- We cease operating the Service
- Required by law or court order
We will provide reasonable notice of termination except in cases of severe violations.

12. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to cleenverify.com/terms, with notice provided via:
- Email notification (for material changes)
- In-app notification
Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to changes, you must discontinue use.

13. Dispute Resolution and Governing Law
13.1 Governing Law
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law principles.
13.2 Jurisdiction
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
13.3 Informal Resolution
Before initiating legal proceedings, you agree to attempt informal resolution by contacting us at info@cleenverify.com. We will attempt to resolve disputes in good faith within 30 days.

14. General Provisions
14.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CleenVerify regarding the Service.
14.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full effect.
14.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
14.4 Assignment
You may not assign or transfer these Terms without our consent. We may assign these Terms to any successor entity.
14.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, war, pandemics, or infrastructure failures.
14.6 Language
These Terms are provided in English. In case of translation discrepancies, the English version prevails.
